These Terms of Service ("Terms") govern your access to and use of the e-Prescribe.net website, registration process, and e-prescribing services (collectively, the "Service"). The Service is operated and administered by HealthTech, Inc. ("HealthTech," "we," "us," or "our"), the administrator of the e-Prescribe.net e-prescribing platform. By registering for, accessing, or using the Service, you agree to these Terms.
The Service is intended for licensed healthcare providers, authorized prescribers, and practice staff acting on their behalf. You represent that you have the authority to enter into these Terms on behalf of yourself or your organization, and that all registration information you provide is accurate and current.
e-Prescribe.net provides standalone electronic prescribing software certified on the Surescripts® network, including support for EPCS (Electronic Prescribing of Controlled Substances) where applicable. Features, availability, and pricing may change from time to time. We do not guarantee uninterrupted access and may perform maintenance with reasonable notice when practicable.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security or compliance risk.
Subscription fees, setup fees, verification fees, and other charges are described at the time of registration or in your service agreement. Fees are billed in advance according to your selected billing cycle unless otherwise stated. You authorize us to charge your designated payment method for all applicable fees. All fees are quoted in U.S. dollars unless otherwise noted.
One-time fees (including setup and third-party verification fees) are non-refundable once processing has begun.
You may cancel your subscription by submitting a written cancellation request through our support portal or by email to [email protected]. Cancellation requests must be submitted in writing as we maintain a documented record of your request. Phone or verbal cancellation requests are not accepted.
Cancellations are effective immediately upon our receipt of your valid written request, unless you specify a different cancellation date in your request. You may request cancellation for a specific future date; we will confirm the effective date in our written response. Your subscription will not renew. No prorated or partial refunds will be issued for any unused portion of your current billing period. Fees already paid are non-refundable.
We may cancel or suspend the Service for material breach of these Terms, non-payment, abuse of service, or regulatory requirements, following notice when reasonably practicable.
You are solely responsible for compliance with all applicable federal, state, and local laws governing the practice of medicine, pharmacy, and electronic prescribing, including DEA regulations for controlled substances. The Service is a tool to assist licensed providers; it does not replace professional judgment. You are responsible for verifying patient identity, drug interactions, allergies, and prescription accuracy before transmission.

Where the Service involves access to protected health information ("PHI"), use and disclosure of PHI is governed by our Business Associate Agreement or applicable privacy policies, in addition to these Terms. You represent that you have obtained all necessary patient consents and authorizations required for your use of the Service.
The Service, including software, branding, documentation, and content, is owned by HealthTech or its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for your internal practice operations during your subscription term.
The Service integrates with third-party networks and services, including Surescripts® and pharmacy systems. We are not responsible for the availability, accuracy, or actions of third parties outside our reasonable control.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTHTECH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless HealthTech from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of applicable law or professional standards.
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.
